Mandatory rest day?

Sunday approaches 1 June 2025, date on which the elections will be held to choose the new circuit magistrates and district judges. Given this, It is common for doubt about whether this day should be considered mandatory.

It is important to clarify that, in accordance with the provisions of our Constitution and the Federal Labor Law, Sunday 1 June is not considered a mandatory rest day. This is because the law designates as forced rest days to “Ordinary elections”, And this vote for the Judiciary is classified as a character election “extraordinary”, According to the second transitory article of the constitutional reform.

Voting permission:Even when it's not a mandatory rest day, The Federal Labor Law does establish an obligation to employers: They must grant the necessary time to the workers so that they can go to exercise their civic right to vote. During this time, which can be a few hours, You cannot adjust or reduce the salary of working people who have exercised their civic right. This time is considered a salary enjoyment permit, that is to say, The full day must be paid, With its corresponding Sunday premium.

Therefore:

  • Sunday 1 June 2025 It is not a mandatory rest day.
  • Employers must grant a permit with salary enjoyment for workers to go to the polls to cast their vote, for the time they need to exercise their civic right.
  • If Sunday is not part of the usual working day of the worker, You cannot be forced to work. In case it is necessary for a working person to work for any situation that the company requires it, It is recommended to coordinate schedules to ensure that the working person can exercise their civic right.

In all cases it is recommended to agree with the workers the schedules in which they can go to exercise their civic law, In order to have an affectation in the company's productivity, Looking for staggered solutions at times by the different departments, or any modality that allows civic exercise without the productivity or quality of the company's service.
